Spanish e-invoicing mandate: Ley Crea y Crece

Ley Crea y Crece affects all companies and professionals that exchange invoices within the Spanish territory.

Companies with a turnover of more than EUR 8 million will have one year, 12 months from the entry into force of the law to adapt their business to the electronic invoicing regulations established. Companies with a turnover of less than EUR 8 million must adapt to the regulations within two years, 24 months, of the entry into force of Ley Crea y Crece.

An electronic invoice is a computer message that has a defined structure and complies with the semantic data model EN16931 of the European Committee for Standardization. • UN/CEFACT XML invoice message, which is applicable to the whole industry according to the XML 16B schemas (SCRDM - CII). 

• Invoice and credit note UBL messages, as defined in ISO/IEC 19845:2015.

• EDIFACT invoice message, following the ISO 9735 standard.

• Facturae message, in its updated version for invoicing between entrepreneurs and professionals.

• To issue and transmit electronic invoices as well as receive them in accordance with article 8 bis of the Regulation approved by Royal Decree 1619/2012, 30 November.
• Publicly disclose the platform used to receive e-invoices on the company's website.
• Report the status of the invoice within a maximum period of four (4) calendar days, excluding weekends and national holidays: acceptance or rejection of the invoice and its date, and payment of the invoice and its date.
• Send a copy of the invoice issued to the public e-invoicing solution.
